Municipal Contract Matters
While with GGU, D. R. has counseled many clients, both private and governmental,
on a wide variety of issues involving municipal contracts, including but
not limited to:
- Negotiation and drafting of contract terms and conditions.
- Responses to invitations for bids and requests for proposals.
- MBE/WBE/DBE requirements and participation.
- Compliance with municipal ordinances.
- Construction claims and disputes.
Prior to GGU, D. R. was supervising attorney with respect to the
following, among other, municipal and commercial contract matters:
- Actions involving constitutional and statutory challenges to "local
business preference" used in municipal bidding.
- Drafting of the local hiring ordinance.
- Action concerning award of concession contract at O'Hare International
Airport.
- Action concerning award of bus contract at O'Hare International Airport.
- Action concerning award of road construction contract.
- Action concerning certification of a company as a Minority Business
Enterprise.
- Action concerning award of development contract.
- Numerous MBE/WBE/DBE matters.
General Municipal Matters
D. R. was lead counsel with respect to the following,
among other, municipal matters:
- Action concerning construction
of a traffic barrier on Howard Street.
- Action concerning the enforceability of tax
on the rental of personal property.
- Administrative proceedings regarding the operation of bridges.
- Dispute regarding the responsibility to repair and maintain viaducts.
Commercial Matters
D. R. was lead counsel for numerous commercial matters, including the following::
- Drafting form purchase order agreements.
- Drafting and counseling regarding confidentiality agreements, consulting
agreements, partnership agreements, and employment agreements.
- Counseling regarding corporate and partnership formation.
- Action revolving around partnership agreement to develop a chain
of restaurants.
- Action revolving around agreement to develop a casino, usurpation
of corporate opportunity, and misappropriation of corporate funds.
- Action revolving around misappropriation and misuse of corporate
funds.
- Action involving breach of partnership agreement.
- Action involving claims for defective work performed by software
designer.
- Action concerning alleged breach of asset purchase agreement involving
the sale/purchase of a national chain of grocery stores.
- Action concerning alleged tortious interference with a real estate
broker agreement.
- Arbitration concerning responsibility for environmental clean-up
costs.
- Dispute regarding construction of improvements to high-rise apartment
building.
- Actions involving claims that certain medical devices were defective.
Construction Matters
At GGU, D. R. has been the lead attorney for various clients (including
owners, general contractors, and subcontractors) with respect to the following,
among other, construction matters:
- Action involving responsibility for accident arising out of construction
of transit system.
- Various actions concerning responsibility for property damage caused
during construction projects.
- Drafting and counseling regarding construction contracts and subcontracts.
- Drafting and counseling regarding joint venture agreements for construction
projects.
- Disputes regarding insurance coverage for construction-related injuries
to real property.
- Disputes regarding delay and acceleration claims.
Prior to GGU , D. R. was the supervising attorney with respect
to the following, among other, construction matters:
- Dispute involving claims for delays, disruptions, faulty specifications,
and extras in connection with the construction of the automated guideway
transit system.
- Action concerning insurance coverage for damage to, and arising out
of, the North Michigan Avenue Bridge accident.
- Action concerning architect/engineer's liability for design deficiencies
in connection with the construction of the International Terminal at
O'Hare International Airport.
- Action involving claims for delays and disruptions in connection
with the construction of sewer system.
- Dispute concerning quality of work performed in connection with the
rehabilitation of a bridge.
- Action involving contractor's claims for extras and delay damages
and claims of conversion/theft against a contractor in connection
with the construction of the Orange Line.
- Action involving claims of breach of contract, promissory estoppel,
trespass, and reverse condemnation in connection with the construction
of Roosevelt Road Bridge.
- Action involving claims of trespass and nuisance in connection with
construction and operation of subway.
- Action concerning claims for extras in connection with construction
at Midway Airport.
- Action concerning forged performance/payment bond.
- Numerous actions and disputes concerning construction extras, delays,
and acceleration in connection with construction of "el" stops,
libraries, subways, roads, and other public improvements.
- Numerous actions concerning public mechanics' liens.
- Claims involving contractor defaults, bond claims, and take-over
agreements.
While with Latham & Watkins, D. R. had significant
responsibilities in the following, among other, matters:
- Arbitration and action involving claims for defective workmanship
and delays in connection with the construction of a coal-fired electric
power plant.
- Actions involving claims for insurance coverage for damage to, and
arising out of, various construction projects.
